Nirbhaya case convicts given deadline for mercy plea

  • A special fast-track court in Delhi in September 2013 had announced capital punishment for the four convicts
  • Three of the convicts are housed in Tihar, while one is lodged in Mandoli

After Supreme Court verdict, the four convicts, Mukesh Singh, Vinay Sharma, Pawan Gupta, Akshay Thakur, of the Nirbhaya case will be hanged after a week. The only remedy left now is to move mercy petition before the President of India for commuting a punishment. The Tihar Jail administration sent a notice on October 29 and informed them that they have only seven days left after receiving the notice to file the mercy petition. Moreover, counsel of the convicts was informed by Tihar Jail Department on call about the development. He assured to apply the mercy plea for all one after the other. 


Meanwhile, ANI has tweeted, “Superintendent, Tihar Jail to the four Nirbhaya case convicts: It is informed that all legal remedies in your case have been exhausted, except the provision of filing ‘Mercy Petition’ against the Capital Sentence before the President of India. If you wish to file the ‘Mercy Petition’ in your case against the capital sentence before the President, you can file it within 7 days of the receipt of this notice, through prison authorities failing which it will be presumed that you are not willing to file mercy petition in your case & the jail administration will initiate further necessary legal proceedings as per law”.

According to the Tihar Jail Director Sandeep Goel, three of the four convicts are behind the bars in Tihar and the fourth one is in Mandoli Jail. 
In South Delhi, on the intervening night of December 16-17, 2012, a heinous crime was committed by six persons, who gang- raped the 23-year-old paramedic student and beat her male friend and thereafter both the victims were thrown out of the moving bus. She was severely assaulted before being thrown out on the road. She succumbed to her injuries on December 29, 2012 at Mount Elizabeth Hospital in Singapore.
One of the accused Ram Singh had hanged himself in the jail and another juvenile, Mohammad Afroz, was convicted of rape and murder and completed the maximum sentence of three years’ imprisonment in a reform facility.
On July 9 last year, the Supreme Court dismissed the pleas of three convicts — Mukesh, Pawan Gupta and Vinay Sharma. The fourth death row convict, Akshay Kumar Singh had not filed a review petition in the Supreme Court.
